1.2 Alcoholic Beverages

Consumption of alcoholic beverages on campus is prohibited.

1.3 Campus Security Information

1.3.1 Compliance with Law

In compliance with the Student Right-to-Know and Campus Security Act (the Act), 20 U.S.C. Sections 1092(a), (e) and (f), as amended, UT Southwestern collects specified information on campus crime statistics, campus security policies, and institutional completion or graduation rates.

1.3.2 Right-to-Know Results of Student Disciplinary Proceedings

Pursuant to federal law, alleged victims of violent crime are entitled to know the results of student disciplinary proceedings on campus concerning the alleged perpetrators.

1.3.3 Reports of Crime

UT Southwestern makes timely reports to the UT Southwestern campus community on crimes considered to be a threat to students and employees, which are reported to University Police or local police.

1.3.3.1 Annual Publication

Annually, in September, UT Southwestern:

  • publishes and distributes a report of campus security policies and crime statistics to all current students and employees,
  • provides copies of the report to applicants for enrollment or employment upon request,
  • and submits a copy of the report to the U.S. Secretary of Education upon request.

This annual campus crime statistics report references crimes which occur on property owned or controlled by UT Southwestern.

1.3.3.2 Policy on Sex-related Offenses

Because UT Southwestern places a high priority on providing a safe and secure environment for students, University Police offer escort services on campus, and police officers conduct seminars, on request, to inform students about campus security and crime prevention. These seminars include information designed to promote awareness of rape, acquaintance rape and other forcible and non-forcible sex offenses.

1.3.3.3 Procedures to Follow in Case of Sexual Assault on Campus

Immediately after the assault, the victim should go to a safe place and call the University Police at 214-648-8911. The victim should not bathe, douche, shower, or change clothes.

The victim should make an official offense report of the assault to University Police. This is important even if the victim decides at a later date not to prosecute the assailant.

If the victim is a student and chooses not to report the assault to the University Police, UT Southwestern encourages reporting to the Associate Deans for Student Affairs at 214-648-2168 or Student Health Services at 214-648-3320.

Student Health Services, located in the Aston Ambulatory Care Center, can assist a student in determining the best course of action to follow after a sexual assault. Some of their services are free of charge; in other cases, especially if referred outside of the Student Health Services, the student is responsible for the cost.

1.3.3.4 Procedures if University Police are Called

A police officer will arrive at the victim's location and take an initial offense report. A written statement will also be taken from witnesses. Officers will secure the crime scene and attempt to locate the assailant.

The victim will be taken to Parkland Memorial Hospital by University Police for a medical examination, treatment of injuries, and a forensic examination to collect evidence to be used in court. Evidence of physical assault will be photographed for evidence.

At the hospital, a nurse will ask the victim if she or he wants to speak with a Rape Crisis Center counselor. If so, the counselor will assist the victim throughout the process and begin counseling and support. The Rape Crisis Center counselor makes no charge (whether or not an official offense report is filed) and is available 24 hours a day.

If the victim files an official offense report of sexual assault, the forensic examination will be paid for by Dallas County.

After completion of these procedures, the University Police will transport the victim home or to a safe place. The investigating officer will conduct a more thorough interview of the victim, if she or he is able and willing to speak about the incident at that time.

If the assailant is apprehended or identified at the time of the crime, he or she will be arrested and taken to jail. The case is then filed with the Dallas County criminal district attorney's office and, after review by the district attorney, will go before the grand jury. The victim must appear before the grand jury. If true billed, the case is assigned to a prosecutor. If the case goes to trial, the Rape Crisis Center will accompany and continue to assist the victim until the case is completed. If no billed, the criminal prosecution of the assailant ends.

If the assailant is a student, a report will be submitted to the UT Southwestern administration regarding the offense.

The UT Southwestern Associate Deans for Student Affairs will investigate allegations of sexual assault brought against a student, in accordance with the UT System Regents' Rules and applicable provisions of the Handbook of Operating Procedures, as they govern nonacademic misconduct. If found guilty of the misconduct, the student may be penalized, up to and including expulsion from UT Southwestern. The penalty imposed by UT Southwestern may be imposed regardless of any action taken by any other authority, such as the district attorney's office.

The student who is a victim of alleged sexual assault has the option to request a change in academic assignment within UT Southwestern from the Associate Deans for Student Affairs. Regardless of the outcome of any hearing or other legal action, such requests will be accommodated whenever possible.

If the assailant is a faculty or staff member, a report will be submitted to the administration regarding the offense.

The UT Southwestern department of human resources will investigate allegations of sexual assault brought against faculty and staff members. If the faculty or staff member is found to be guilty of work-related misconduct under UT Southwestern personnel policies, disciplinary action will be taken, up to and including termination.

The employee or student who is a victim of an alleged sexual assault has the option to request a change of work or academic assignment from the department of human resources or associate deans of student affairs. Regardless of the outcome of the investigation or other legal action, such requests will be accommodated whenever possible.
